Banking Law and provisional injunctions

The Quebec Superior Court rules that a Bank can be ordered, by way of provisional injunction, to reimburse a customer for sums of money debited by the Bank for purposes of setting off an alleged debt contested by the customer. The customer must establish an appearance of right, urgency and satisfy the balance of hardships test. (Marston v.
